WSJ Estimates Over 1,000 DePuy ASR Lawsuits Filed

The legal problems faced by DePuy Orthopaedics over its badly designed ASR hip replacements are well documented, and the number of plaintiffs seeking restitution for the harm they have suffered due to the products’ failures has steadily grown. According to estimates by The Wall Street Journal the number of ASR plaintiffs has now reached over 1,000. Many of these litigants’ cases have been consolidated into one multidistrict litigation centered in the U.S. District Court for the Northern District of Ohio, presided over by the honorable Judge David A. Katz.

Financial estimates by Wells Fargo predict that DePuy and its parent company, Johnson & Johnson could be looking at costs of more than $1 billion in order to settle these claims. This means that the $920 million that Johnson & Johnson reportedly set aside for litigation costs related to the ASR at the end of 2010 may be insufficient to cover the costs that the company will – in fact – face when all is said and done.

Last year, Johnson & Johnson and Ortho-McNeil sought to mitigate these costs by offering to pay out-of-pocket medical costs for people who have suffered a premature failure of their ASR device. Anyone who has suffered such a failure would be well advised to turn down such an offer and seek out the help of an experienced and capable attorney. Agreeing to such an offer could significantly limit the amount of compensation that he or she would receive from DePuy for the harm suffered due to the product’s failure.

Since last August, when DePuy issued an asr hip recall, more and more people have come forward with claims that the product has failed them, resulting in serious harm. As the legal tide builds against DePuy and Johnson & Johnson, so does the likelihood that you will receive compensation for the harm you suffered from DePuy’s negligence. If you have suffered such harm, your next step should be contacting an attorney from the Rottenstein Law Group to discuss your potential DePuy ASR lawsuit .
